Terms of Use

Thank you for using Berry Creative Studio ("we", "our", "us"), owned and operated by Cereal Reads LLC.

1. Agreement of Terms

By buying a template, subscribing to hosting, or just visiting our site, you agree to these Terms. If you don't agree, please don't use our services.

2. What We Do (Services)

We build custom websites ("Custom Websites") and license pre-built websites ("Templates") for authors and—if you choose—host and maintain the finished site on our servers ("Managed Hosting").

3. Your content

You keep all rights to the text, images, and other materials you supply.

You grant us a non‑exclusive license to host, edit (as directed), and display that content solely to run your site.

We'll only show your site in our portfolio or case studies if you give written consent first.

You promise everything you provide is legal to use and doesn't infringe anyone's rights. If a copyright claim pops up, you'll cover our reasonable costs.

4. Templates & license

All code, designs, and related materials we create for you in pre-built websites ("Templates") are the intellectual property of Berry Creative and are licensed—not sold—to you for personal or business use on your own website. Resale or redistribution is not allowed without our written okay. All rights not expressly granted are reserved.

5. Hosting & uptime

Managed hosting is billed monthly. We aim for excellent uptime but offer no formal SLA. The service may be unavailable for maintenance, outages, or events beyond our control. This may include issues, outages, or events from third party providers that we use to provide the service. In the event of a service interruption, we are not obligated to offer refunds, credits, or compensation of any kind.

6. Payments & refunds

Template fees are one‑time and non‑refundable once the repo is cloned.

Hosting fees are billed in advance each month; you can cancel anytime, and the current billing cycle runs to its end. No partial refunds are guaranteed.

That being said, we'd love to work with you to make sure you're happy with the service. Just email us at jacob@beberrycreative.com and we'll work something out.

7. Service & Pricing Changes

We may modify our service offerings or pricing at any time. Updated pricing takes effect at the start of your next billing cycle. We'll do our best to notify you in advance via email or site notice.

8. Privacy & tracking

Our Privacy Policy explains what we collect and how. By using our services, you accept those practices.

9. Disclaimers

Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties—express or implied—about fitness, accuracy, or uptime.

10. Liability cap & indemnity

Liability cap: If we mess up, our total liability is limited to the greater of USD $100 or the fees you paid us in the 12 months before the claim.

Indemnity: You agree to defend and indemnify us against claims arising from your content or breach of these Terms.

11. Governing law & disputes

These Terms are governed by Missouri law. Any disputes will be resolved in the state or federal courts located in Missouri. You and we waive jury trial rights.

12. Changes to these Terms

We can update Terms at any time and will notify you but posting those changes ot this page.If you keep using the service after the effective date, you accept the new Terms.

13. Acceptable Use

You agree not to use our services to host unlawful content, send spam, or otherwise violate applicable laws. We reserve the right to suspend service for violations or any other reason.

14. Age Limit

Our services are intended for users 16 and older. We do not knowingly collect data from anyone under 16.
